Amendment to the Civil Code of Nuevo León: New Rules for the Lease of Urban Properties

The Congress of the State of Nuevo León approved a significant amendment to the Civil Code for the State of Nuevo León regarding the lease of urban properties, introducing new obligations and limits for landlords and tenants.
Pursuant to Article 2346, landlords are now required to issue a receipt for each monthly rent payment made. If such receipts are not delivered for a period of three months, the rent shall be presumed to have been paid, unless a timely demand has been made to claim payment.
This article further specifies that the security deposit required by the landlord from the tenant to guarantee the performance of the tenant’s obligations may not exceed the equivalent of one month’s rent.
Article 2346 BIS, in turn, provides that in leases intended for residential use, the term of the agreement shall be six months, renewable by agreement of the parties. In addition, rent must be set in national currency, and increases may not exceed 10% of the current monthly rent. If an increase exceeding such limit is agreed upon, a new agreement must be executed.
These amendments reflect the legislature’s intention to establish clearer rules regarding leasing matters. Consequently, new lease agreements executed in Nuevo León must comply with the provisions set forth in this new legal framework.
Amendment to the Civil Code of Nuevo León: New Rules for the Lease of Urban Properties
Derived from the amendments to Articles 2346 and 2346 BIS of the Civil Code, the following changes are introduced:
- The landlord must issue monthly rent receipts.
- If receipts are not issued for three months, se presume payment is presumed.
- The security deposit may not exceed one month’s rent.
- In residential leases, the term shall be 6 months,renewable.
- Rent must be set in national currency.
- Los Rent increases may not exceed 10%;%if they exceed this limit, a new agreement must be executed.
On September 26, 2025, Decree No. 107 was published, which includes an amendment to the Civil Code of Nuevo León regarding the lease of urban properties.
Pursuant to its First Transitory Article, the Decree entered into force on the day following its publication in the Official Gazette of the State of Nuevo León, that is, on Monday, September 28, 2025.
